Trial of the attacks in Brussels: the lawyer of El Haddad Asufi requests the inadmissibility of the prosecution

The lawyer believes that the latter has already been tried. “There is not a single incriminating element that has not already been reproached to him in Paris, everything has already been debated,” he said. The Paris Assize Court sentenced Ali El Haddad Asufi to ten years in prison last June, of which he will have to serve at least two thirds of the sentence.

He appeared every day for nearly a year in Paris, his counsel recalled. He never refused to appear, “he always collaborated”. “If he does not appear” during this trial, “we can simply project the videos of his interrogations in Paris, the answers to the questions will be the same”, he quipped.

In the afternoon, the prosecution, through the voice of the prosecutor Paule Somers, swept aside the arguments of Me De Taye, considering that nothing violates the principle of ‘non bis in idem’ (no one can be prosecuted or punished criminally for the same facts). “This principle presupposes an identity of facts”, this is not the case here, she replied. “These are separate material facts” both temporally and geographically. A reasoning followed by Me Masset for the civil parties, the latter also recalling that the indictment chamber had already ruled on similar requests from two other defendants convicted in Paris, and that the case of Mr. El Haddad Asufi did not no exception.

Me Maryse Alié (Life4Brussels) for her part felt that this request “went too far”. “My arms are falling (…) We expect calm debates with respect for all parties,” she said, recalling the hundreds of people injured in the Brussels attacks who are waiting for answers for these specific facts.
